| Recent settlements: | Fatal Accident Claim: Negligent failure to investigate and/or treat symptoms of PE following surgery. The negligent failure resulted in the patient’s death, which would have been avoided with appropriate investigation and treatment.
The Estate/Claimant’s family was awarded £250,000. Negligent Surgery: Claimant underwent a third caesarean section. Due to previous complications it was documented that any further sections should only proceed with appropriate Consultant support. This did not happen. The surgery was sub-standard in that the large bowel was included in the closure of the abdominal wound following delivery which led to the formation of a faecal fistula from the sigmoid colon requiring a Hartmann’s procedure colostomy and subsequent reversal. Thereafter the Claimant had numerous wound complications. Claimant was awarded £155,000 Surgical Infection Claim: Surgeon failed to diagnose that the Claimant (aged 72 years old at the date of negligence, 77 years old at the time of settlement) was suffering with a deep infection in the hip. As a result of the negligence the Claimant suffered from a protracted and chronic deep infection as a consequence of which the Claimant had to undergo a 2 stage hip revision operation. Had the deep infection in the Claimant’s hip been treated by operative intervention the infection would have been eradicated and the Claimant would have made a full recovery from the hip replacement operation without the need for further surgery.
