Charity Tribunal consultation begins

Robert Nieri, senior associate, has spoken to Third Sector, the leading source of information for UK charities, voluntary organisations and social enterprise, about plans for the new Charity Tribunal which will hear appeals from Charity Commission decisions and allow the Commission and the Attorney General to pose questions to clarify aspects of charity law.

Robert told Third Sector on 21 August:

"The whole point is to reduce the cost of disputes. At the moment, if you're unhappy with a Charity Commission decision, you have to appeal to the High Court, and that is costly and takes time."

The Ministry of Justice is currently seeking feedback from interested stakeholders on the Tribunal's practices and proceedings but on two issues in particular: whether 28 days is enough time to appeal from a decision of the Charity Commission and whether the Tribunal should publicise issues raised with it anywhere other than on its own website.
