Development specialist Richard Osborn is another leading lawyer to be recruited into one of the largest and most respected commercial property teams outside of London.Richard joins the Leicester office of East Midlands heavyweight law firm Freeth Cartwright LLP as a partner after nearly five years at the Birmingham office of Eversheds. It is a return to the city for him as he is a graduate of the University of Leicester and was previously a member of the property team at both the Leicester and Birmingham offices of Edge & Ellison (now Hammonds) and has also lived in Leicestershire for the last fifteen years.

1 July 2007 is D-day for those who light up at work throughout England. Recent surveys have indicated that many employers are unaware of the detailed implications of the new laws with 41% not realising smoking rooms would need to be closed and 53% of employers unaware that work vehicles will also be covered by the new rules.The smoking ban will virtually cover all enclosed public premises used as a place of work including offices, shops and factories. Whilst there will be no legal requirement for a business to provide external smoking areas to cater for those who want to smoke or practice the workplace phenomenon of ‘smirting’ (flirting with fellow smoking colleagues outside the place of work), employers who do provide shelters will need to ensure that any shelter or area complies with the legal requirements.

Businesses and directors across the region are being advised that they need to be aware of their duties when senior figures leave to join new companies.That’s the warning from law firm Freeth Cartwright following a recent High Court case which gave a judgment on the question of whether a director who had resigned from a company and the new company he then set up were liable to account to his old company for profits.
