PLANNING TO AVOID DISPUTES

A recent survey of the cause of commercial disputes indicated that simple improvements to risk management policies and procedures could significantly minimise the chance of becoming embroiled in costly disputes.

Causes of dispute frequently cited were:

(1) poor communication (79%);

(2) failure to deliver (69%);

(3) badly drafted contracts (57%);

(4) management failing to take ownership (51%); and

(5) having no contract in place (44%).

What can be done?

Adopt a two stage approach:

REVIEW

(1) current contracts;

(2) internal procedures; and

(3) seek feedback from staff as to operational issues which cause contract conflict.

IMPLEMENT

(1) update/revise the company’s terms of business;

(2) staff training on contractual risks; and

(3) improved internal procedures.
